Powered Athlete Parent/Guardian Agreement & Terms

1. Powered Athlete Shops
X-Caliber Sports provides youth athletes with opportunities to promote themselves and sell approved merchandise through X-CaliberSports.com.
A Powered Athlete Shop allows an eligible youth athlete to sell merchandise through the X-Caliber marketplace. Because Powered Athletes are minors, parent or legal guardian authorization is required.
By applying for or maintaining a Powered Athlete Shop, the parent or legal guardian agrees to these Terms.
2. Parent/Guardian Authorization
The parent or legal guardian submitting the application confirms that they are the athlete’s parent or legal guardian and have the authority to authorize the athlete’s participation.
The parent or legal guardian understands that the athlete’s name, images, shop, products, and related information may be publicly displayed on X-CaliberSports.com.
The parent or legal guardian agrees to assist the athlete in following these Terms and overseeing their participation in the Powered Athlete Shop program.
3. Products & Approval
Athletes may sell:
- Custom merchandise produced through X-Caliber and its production partners.
- Their own approved products that they supply and fulfill themselves.
All athlete-submitted products must be reviewed and approved by X-Caliber before being published.
Products must be accurately represented, available for sale, and legally permitted to be sold.
X-Caliber may reject or remove products that are inaccurate, unavailable, defective, inappropriate, or otherwise violate these Terms.
4. Marketplace Rules
X-Caliber is intended to provide a positive and appropriate environment for youth athletes.
Products, listings, and shop content may not contain or promote:
- Vulgar, obscene, or sexually explicit content.
- Hate, bigotry, discrimination, or harassment.
- Threats or content intended to harm or intimidate others.
- Illegal products or activities.
- Content that infringes another person’s copyright, trademark, or other rights.
- Other content that X-Caliber determines to be inappropriate for its youth-oriented marketplace.
5. Athlete & Parent/Guardian Responsibilities
The athlete and parent or legal guardian are responsible for athlete-submitted products, including:
- Product availability and inventory.
- Accurate descriptions and photographs.
- Product condition.
- Proper packaging and fulfillment.
- Accurate shipping information.
- Timely shipment of orders.
- Providing tracking information when available.
For athlete-submitted products, orders must generally be shipped within three weeks unless X-Caliber approves an exception.
X-Caliber may provide shipping labels based on the information supplied by the shop owner. The shop owner is responsible for providing accurate product weight and dimensions and may be responsible for additional shipping costs resulting from inaccurate information.
6. Earnings & Payments
Athlete earnings are based on the applicable commission structure for each product.
For merchandise produced through X-Caliber and its production partners, the applicable production cost and X-Caliber commission are deducted before the athlete’s share is calculated.
For eligible athlete-submitted products that do not require X-Caliber to produce the merchandise, the athlete may receive 90% of the product sale, with X-Caliber retaining 10%.
Shipping charges are separate from the product sale and are not included when calculating the athlete’s product commission.
Athlete earnings are generally eligible for payment after applicable orders have been successfully fulfilled. X-Caliber may delay payment for orders involving refunds, disputes, chargebacks, cancellations, or other unresolved issues.
Payments are generally issued on the first day of each month. Eligible early payouts may be requested by the athlete or parent/legal guardian.
A valid payment account must be connected before earnings can be distributed. Payment arrangements for minors may require parent or legal guardian involvement and must comply with the requirements of the applicable payment provider.
7. Intellectual Property
Athletes and their parent or legal guardian are responsible for ensuring that products, artwork, photographs, logos, designs, and other submitted content may legally be used and sold.
Content that infringes another person’s copyright, trademark, publicity rights, privacy rights, or other legal rights may not be submitted.
X-Caliber may remove content when it receives a credible complaint or otherwise determines that the content may violate another person’s rights.
8. Suspension or Termination
X-Caliber may reject, suspend, restrict, or terminate a Powered Athlete Shop or individual product for violations of these Terms.
Examples include:
- Failing to fulfill orders.
- Listing products that do not exist or are unavailable.
- Selling products that are materially different from their listing.
- Providing inaccurate product or shipping information.
- Selling faulty or improperly represented products.
- Uploading prohibited or inappropriate content.
- Harassing or threatening customers, athletes, shop owners, or X-Caliber representatives.
- Engaging in fraudulent, deceptive, or unlawful activity.
- Repeatedly failing to meet marketplace requirements.
9. Athlete Reaching Adulthood
The Powered Athlete program is intended for youth athletes.
When an athlete reaches adulthood, their participation in the youth Powered Athlete program may end or require transition to a different account, shop, or agreement.
X-Caliber may contact the athlete and/or parent or legal guardian before making changes related to the athlete’s age.
10. Changes to These Terms
X-Caliber Sports may update these Terms as the Powered Athlete program, marketplace, products, or services develop.
Material changes may require renewed acknowledgement or authorization.
11. Parent/Guardian Acknowledgement
By submitting the Powered Athlete application and acknowledging these Terms, the parent or legal guardian confirms that:
- They are the parent or legal guardian of the identified athlete.
- They have authority to authorize the athlete’s participation in the Powered Athlete Shop program.
- They have reviewed and understand these Terms.
- They understand that the athlete’s shop, products, and related information may be publicly displayed.
- They agree to assist the athlete in complying with these Terms.
- The information provided during the application and acknowledgement process is accurate to the best of their knowledge.
Parent/guardian acknowledgement is required before a Powered Athlete Shop can be approved.
